CANTON — Judge John Poulos denied a request to lower the bond for Erick M. Howard, a former two-time Ohio Mr. Football who is accused in a home invasion robbery.

Howard made an initial appearance Thursday morning in Canton Municipal Court. He is being held in the Stark County Jail on a $250,000 bond and charged with aggravated burglary, rape and theft.

Rufus Sims, Howard’s lawyer, asked that the bond be reduced. He said Howard has shown good faith by giving a statement to police during the investigation and turning himself in earlier this week. He added that Howard is well known in the community and has no prior felony convictions.

“He’s not a flight risk,” Sims said when he asked Poulos to lower the amount.

North Canton police have charged Howard, 20, Seth R. Obermiller, 19, and Michael A. Taylor, 20, for the Aug. 20 incident at an apartment in the 1100 block of Sunford Avenue SE.

A couple told police they were awakened during the night by two men with guns in their apartment. The couple said the men bound and robbed them. The woman said she was sexually assaulted.

Howard and Obermiller are accused of being the two men who entered the apartment. They are charged with aggravated burglary, rape and theft. Taylor is accused of being the lookout and is charged with complicity to aggravated burglary and theft.

Bond for Obermiller and Taylor also has been set at $250,000.

The three men have a preliminary hearing set for Friday afternoon.

Howard graduated from North Canton Hoover High School in 2010. He played football and set Stark County records for yards gained rushing and scoring. The Associated Press recognized him as Ohio’s Mr. Football after the 2008 and 2009 seasons.

With a swift pat on the back, Defense Attorney Rufus Sims gave Erick Howard one last piece of advice before police escorted him out of the courtroom today.

"Stay strong," Sims told Howard, who was just found guilty on several felony charges following a three day-long trial in Stark County Common Pleas Court.

A 12-member jury found Howard guilty on all counts — aggravated burglary, aggravated robbery, rape and kidnapping, all carrying firearm specifications. He joined two others in tying up and robbing a North Canton couple in their home Aug. 20. Howard also raped the female victim.

He's slated to be sentenced at 1 p.m. Tuesday in Judge Taryn L. Heath's courtroom.

He faces 31 years in prison.

In Assistant County Prosecutor Chryssa Hartnett's closing arguments, she said Howard was caught on tape at Wal-Mart buying supplies to use in the Aug. 20 home invasion.

There are incriminating phone records and firsthand accounts from co-defendants who implicated him.

And a victim even identified Howard as the person who tied her up, robbed her and raped her in her bedroom, Hartnett said today during her closing arguments in Howard's trial.

"To believe it was someone other than Erick Howard in that room, you would have to believe the mother of all coincidences has occurred and the stars have aligned to make all these other things coincidental."
